1. Interpretation

Definitions:

“HITZ Cricket” means The Cricket Box Ltd with correspondence address of 18 Ormonde Road, Godalming, GU7 2EU

“Bookings” means the booking of the simulator time, as per our website.

“Booking Fee” means the fee charged to Members, guests of Members that are attending with a Member and non-members.

“Customer” means the person who is named on the booking form.

“Lane” means the simulator set up at your chosen site.

“Terms and Conditions”: means the terms and conditions of booking the Lane set out below.

“Website”: means HITZ Cricket’s website https://www.HITZ Cricket.com


2. Agreement to these Terms

When booking the Lane at HITZ Cricket, the Customer confirms that it has read and agrees to be bound by these Terms and Conditions including the Health and Safety Waiver.


3. Booking Terms and Payments

3.1 Customers shall pay the cost of booking. This fee shall not be refunded if a Customer is unable to attend the Booking, it can be rescheduled if we receive 48 hours notice. There is a  10 Minute Grace period after booking, where you’ll be refunded. 

3.2 All charges quoted to the Customer for the provision of Bookings are inclusive of VAT.

3.3 If a Customer is unable to attend a booking they have made, they may request to reschedule to a later date, subject to availability. Rescheduling of bookings should not be done within 48 hours of the original booking date.

3.4 If a booking is rescheduled with less than 48 hours notice, the Customer may be subject to an additional fee, at HITZ Cricket’s discretion.

4. Warranties and Liability

HITZ Cricket shall not be liable to the Customer or be deemed to be in breach of these Terms and Conditions by reason of any delay in performing, or any failure to perform, any of HITZ Cricket’s obligations in relation to the Booking, if the delay or failure is due to any cause beyond HITZ Cricket’s reasonable control, and time shall not be of the essence. In respect of an event cancelled by HITZ Cricket for any reason whatsoever, liability shall be limited to refunding the Booking Fee.


5. General

5.1 If you enter your details in any enquiry form or contact form you are giving your express permission for your details to be added to our data base for contact and marketing purposes. Your details maybe provided to a third party, see Clause 5.4 below.

5.2 HITZ Cricket understands that email marketing is a useful tool, however, Customers are politely asked to keep email marketing to other Customers to a minimum and to include an ‘opt-out’ facility on every email. HITZ Cricket reserves the right to suspend the Customers’s access to the Website in the event of complaints from other Customers, and such complaints would constitute a breach of these Terms and Conditions.

5.3 Customers and attendees at an Event acknowledge and accept that HITZ Cricket reserves the right to publish email contact details of the attendees at each Event. The contact details may be provided to other attendees, the speaker, the venue, nominated charities or other worthy causes (as determined by HITZ Cricket from time to time). If you would prefer that your contact details are not published, please let us know by contacting us at info@HITZ Cricket.com

5.4 As a Customer of HITZ Cricket, the Customer agrees to conduct themselves in a professional and business-like manner, treating other customers and the team with respect at all times. If HITZ Cricket should receive a complaint about any Customer’s behaviour, it reserves the right to ask the Customer not to return. Such complaints would constitute a breach of these Terms and Conditions.

5.5 Booking of the Lane at HITZ Cricket is at the sole discretion of HITZ Cricket and it reserves the right to refuse a Customer.

5.6 Our website uses cookies to monitor browsing preferences. If you do allow cookies to be used, certain personal information may be stored by us. We will never share your personal details with third parties.

5.7 Wavier. No failure or delay by either party in exercising any of its rights under these Terms and Conditions shall be deemed to be a waiver of that right, and no waiver by either party of any breach of these Terms and Conditions by the other shall be considered as a waiver of any subsequent breach of the same or any other provision.

5.8 Confidentiality

5.8.1 Each party undertakes that it shall not at any time disclose to any person any confidential information concerning the business, affairs, customers, clients or suppliers of the other party, except as permitted by below.

5.8.2 Each party may disclose the other party’s confidential information:

(a) to its employees, officers, representatives, subcontractors or advisers who need to know
 such information for the purposes of carrying out the party’s obligations under these
 Terms and Conditions. Each party shall ensure that its employees, officers, representatives,
 subcontractors or advisers to whom it discloses the other party’s confidential information
 comply with this clause; and

(b) as may be required by law, a court of competent jurisdiction or any governmental or regulatory authority.

5.8.3 Neither party shall use the other party’s confidential information for any purpose other than to perform its obligations under these Terms and Conditions.

5.9 Notices. Any notice to HITZ Cricket is to be sent in writing to 18 Ormonde Road, Godalming, GU7 2EU or by email to info@HITZ Cricket.com. Notices to the Customer will be sent to the address on the booking form, unless HITZ Cricket is otherwise informed in writing. The provisions of this clause shall not apply to the service of any proceedings or documents in any legal action.

5.10 Severance. If any provision or part-provision of these Terms and Conditions is or becomes invalid, illegal or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant provision or part-provision shall be deemed deleted. Any modification to or deletion of a provision or part-provision under this clause shall not affect the validity and enforceability of the rest of the Terms and Conditions.

5.11 Entire agreement. These Terms and Conditions constitute the entire agreement between the parties and supersedes and extinguishes all previous agreements, promises, assurances, warranties, representations and understandings between them, whether written or oral, relating to its subject matter.

5.12 Each party agrees that it shall have no remedies in respect of any statement, representation, assurance or warranty (whether made innocently or negligently) that is not set out in this agreement. Each party agrees that it shall have no claim for innocent or negligent misrepresentation based on any statement in these Terms and Conditions.

5.13 Variation. No variation of Membership shall be effective unless it is in writing and signed by the parties (or their authorised representatives).

5.14 Force majeure. Neither party shall be in breach of these Terms and Conditions nor liable for delay in performing, or failure to perform, any of its obligations under these Terms and Conditions if such delay or failure result from Bookings, circumstances or causes beyond its reasonable control.

5.15 Third parties. No one other than a party to these Terms and Conditions shall have any right to enforce any of its terms.

5.16 Governing law. These Terms and Conditions, and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with it or its subject matter or formation shall be governed by, and construed in accordance with the law of England and Wales.

5.17 Jurisdiction. Each party irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with these Terms and Conditions or its subject matter or formation.


HEALTH AND SAFETY WAIVER

When booking the Lane at HITZ Cricket, the Customer confirms that it has read and agrees to be bound by these the Health and Safety Waiver.

I understand that participation in the Batfast Simulator may result in injury/illness, permanent physical or mental impairment or even death. By 


These injuries may be minor or may be career or life threatening. I understand that Batfast Cricket Centres LTD and its clients cannot be held responsible for any injuries or conditions that may be caused by the actions of participants. I understand and agree that situations may arise during these activities, which may be beyond the control of participants. I release, forever discharge, and agree not to sue Batfast Cricket Centres LTD, Board of Trustees, administrators, employees, clients, or other participants. I hereby waive all such claims, which I have now or may hereafter have against the above name organizations or persons, however caused. I agree that it is my sole responsibility to be familiar with the physical and/or mental demands associated with the above-named activities. With these demands in mind, I have no physical or medical condition which, to my knowledge, would endanger myself or others if I participate in this Batfast Simulator, or would interfere with my ability to participate. I also agree to abide by any established rules or regulations while participating.


I understand that there are certain inherent risks involved in participating in Batfast Simulator. I acknowledge the fact that these risks exist, and I am willing to assume responsibility for any and all such risks while participating in Batfast Simulator.


I also agree to the following:

1. Voluntarily assume all risks associated with my participation in these activities.

2. I accept that Batfast Centres LTD and its personnel are not to be held responsible for any pre-existing medical condition(s) that I may have.

3. I understand that I must wear any recommended equipment as dictated by the rules. Failuremto do so may put me at risk of injury.


Batfast Cricket Centres LTD draws the attention of all participants to the fact that playing equipment such as Bats and balls, if handled or used incorrectly, could be a danger to adults and children.


It is the responsibility of the participants (parents or guardians) to ensure that children are supervised in such a way as to avoid the possibility of any accident or injury from this cause or any other.


When playing in the simulator the following additional items should be adhered to at all times, if applicable:

  • Follow all instructions provided by the member of staff in relation to health and safety matters, if applicable.
  • Never more than one player at a time in the playing area during game play.
  • No food or drink to be taken into the batting cage at any time.
  • No leaning on the batting cage at any time.
  • Ensure spectators stand away from the net for their safety.
  • No one under the age of 4 years should play the BatFast simulator.
  • If pregnant the recommendation is not to play the BatFast Simulator.
  • Do not play the simulator if injured.
  • People with epilepsy or other conditions sensitive to light or sound, back or neck injuries, high blood pressure and/or heart conditions do not play the BatFast Simulator.
  • No glasses, loose jewellery or phones to be worn whilst playing.
  • Appropriate footwear to be worn when playing the BatFast simulator. Flip-flops, sandals, open toed shoes and high heeled shoes are not classed as appropriate footwear.
  • The person in the playing area should always be facing the projection screen, have focus and awareness of where from and when the next ball will be delivered.
  • Select a sports bat/racket/stick that you can comfortably hold and swing without letting go. Ensure that the sports bat/racket/stick is fit for purpose before playing with it, check there are no sharp edges, cracks or similar that could cause damage to you or the surroundings.
  • Do not play the BatFast Simulator if heavily intoxicated or under the influence of drugs.
  • If at any point you feel unsafe or uneasy in the playing area, ask the closest person to the user interface to pause the game and step out of the playing area safely. If at any point you feel under immediate danger ask the closest person or personally press the emergency stop (red button) on the simulator and seek a member of staff for help before continuing.
  • During game play select the appropriate level to play against, if you have never or in a long time played the sport select Beginner level. If you are a professional athlete then select Club or International level to begin with. If you are unsure at what level to start at select Beginner level. On a ball by ball basis you can adjust the level of delivery you face against.
  • Please be aware that balls may collect in the lane during play, these may pose a danger to tripping / falling over, or deliveries may ricochet off balls on the floor causing unpredictable ball trajectories. To prevent any issues please push balls away from the batting area as well as the area where balls bounce.
  • Before playing each new type of sport on the BatFast simulator I will watch the brief introduction video that explains how to play the game (if it is available).
  • Do not approach the screen when the game is in play.
  • Do not hit targets with a bat.
